Tasks of distributors, traders

The most important thing is to keep an accurate record of the safety data sheets: when we received the data from whom and when we gave it to whom. If the supplier does not respond, it is worth asking each year if the data sheet has changed. For a new version, you must pass on the modified version to any customer who has purchased in the past year. It may be fax, letter, e-mail, the point is that we can confirm the transfer. When you post data sheets on the Internet, only the exact link is considered a transfer, and buyers must be notified of any changes in the future.

The data sheets should be made available as soon as possible. Ideally, a copy is printed on each product and every employee who comes in contact with customers knows exactly where they are and how to get them.

The first Hungarian distributors of the hazardous substance or mixture must be notified of the products in the OSZIR system. It is not enough to submit a notification once. If data sheet changes, a change notification has to be made. Currently, the first application is subject to a fee, the others are free. You can pay by bank transfer or by credit card after filing. Dangerous products can also be reported in the OSZIR.

The label and the leaflet may contain other hazards, if they do not contain the same hazard symbols and text, but sometimes the name does not match. This should be checked at each purchase and, if necessary, either a new data sheet must be requested or, if there is no manufacturer's data sheet for the particular label, it should not be taken over.

The introduction of EU legislation has made it difficult to import chemicals. The most important task when importing substances is the REACH registration. In any case, you should consult with the non-EU manufacturer on whether he has registered the substances. The registration is tonnage-dependent and applies to quantities above 1000 kg per substance per year. If a REACH registration number is already included in the safety data sheet, this has already been done and it is very likely that you can check the supplier on the ECHA website. Registration can also be done by the manufacturer's sole representative within the EU and then anyone can import the substance into the EU.

When importing mixtures, not only REACH registration, but also C&L notification is possible. The latter means that all dangerous substances, whether in quantities or not, imported into the EU, either as a substance or in a mixture, which are subject to REACH registration, contribute to the dangerousness of the product or reach a certain concentration in the mixture. However, this is no longer done for us, it is up to each importer to do so.
